Please read these Terms of Service ("Terms") carefully before using the Favorize mobile application ("the App") operated by Favorize ("us", "we", or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
1. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. User Content
Our App allows you to create, upload, and share content such as wishlists and comments ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post.
By posting User Content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise use your User Content in connection with operating and providing our App.
You represent and warrant that:
- You own the User Content or have the right to use it and grant us the rights and license as provided in these Terms.
- The posting of your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.
3. Prohibited Uses
You agree not to use the App:
- In any way that violates any applicable national or international law or regulation.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," or "spam."
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
- To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App.
4. Intellectual Property
The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Favorize and its licensors. The App is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Favorize.
5. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may discontinue using the App or delete your account within the App settings.
6. Limitation of Liability
In no event shall Favorize, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the App.
7. Disclaimer
Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision is held to be invalid or unenforceable, the remaining provisions will remain in effect.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
